Marc A. Hubbard

Marc has engineering and law degrees and over thirty years of experience as an intellectual property lawyer. He has been a registered patent agent and attorney with the United States Patent and Trademark Office since 1987 and has been admitted to the State Bar of Texas to practice law in Texas since 1988.

He primarily represents technology-focused entrepreneurs, startups, early-stage ventures, and established small and medium-sized businesses that need comprehensive assistance and advice on intellectual property issues critical to their success.

In addition to advising clients on patent, trademark, copyright, and trade secret protection strategies, he writes and prosecutes patent applications, represents applicants and patent owners in various proceedings before the United States Patent and Trademark Office, coordinates and directs foreign patenting and trademark registration, manages global patent and trademark portfolios, provides guidance on avoiding third party IP rights, provides opinions on patent validity and infringement, conducts clearance search and reviews. He has written a wide range of agreements involving the licensing, cross-licensing, purchase, and sale of intellectual property rights, technology transfer with research institutions, and software development and integration services. He regularly collaborates with lawyers handling bankruptcy and various corporate transactions on IP issues or assets involved in those matters.

His clients’ technologies are primarily in the electrical, software, telecommunication, mechanical, and materials fields. Some examples of technologies that he has worked with in patent matters are:

• computer security, including user identity and access management for computer networks; digital rights management and encryption; block-chains; image processing; and software applications; 

• data and telecommunications networks, including network protocols, switches, routers, and optical networks;

• medical devices; robotic and image-guided surgery; implants; medical treatments and interventional and surgical procedures.

• wireless networks, including air interfaces, access schemes, modulation schemes, radio circuits, and radio networks; 

• various electrical circuits and devices; 

• mechanical devices and systems, such as manufacturing and sorting equipment, robotic systems, heavy machinery, oilfield services equipment, and downhole tools; 

• geothermal systems; 

• materials, such as rubbers and superhard materials; and

• consumer products.

He has earned the respect of his peers by being invited to be a fellow of the Dallas Bar Association, the Texas Bar Association Foundation, and the American Intellectual Property Law Association (AIPLA), a master in the Barbara M.G. Lynn American Inn of Court, the chair of the IP section of the Dallas Bar Associate association, the chair of the Patent Law Committee and other committees of AIPLA, and a member of the Board of Directors of AIPLA. D Magazine selected him as one of the Best Lawyers in Dallas in 2018, 2020, 2021, and 2022. Thompson Reuters recognized him as a “Texas Super Lawyer” in 2019, 2020, 2021, and 2022. 

Marc has testified as an expert witness in Federal district court on patent prosecution topics.

He has been an adjunct clinical professor of law, planned and chaired legal education programs, lectured at legal education meetings, and participated in pro bono educational programs for the public. Educating and working on public policy and advocacy efforts to improve the domestic and international IP system has expanded his skills and knowledge and served his clients by improving the IP system.

Before starting Hubbard Law, Marc was a partner in the intellectual property groups of several large general practice firms in Dallas, Texas.
